Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MyAthlete mobile applications and web platform (collectively, the "Service"), operated by MyAthlete ("we," "us," or "our").
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. The Service & Our Agreement
MyAthlete is a comprehensive platform for managing and tracking competitive swimming club activities. Our Service is provided as a "Software as a Service" (SaaS) solution primarily to swimming clubs (each, a "Club").
The Club is our primary customer. An agreement (the "Subscription Agreement") between us and the Club governs the subscription terms, fees, and duration. These Terms apply to all individual users (Admins, Coaches, Parents, Swimmers) who access the Service under a Club's subscription.
2. User Accounts
Access to the Service requires a user account. Your account is provided to you under your Club's subscription.
- Account Creation: You must be invited by your Club Admin and may need to use a specific "Club Access Code" to register.
- Account Security: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We strongly recommend enabling Multi-Factor Authentication (MFA).
- User Roles: Your access to features and data is determined by the role assigned to you by your Club Admin (e.g., Admin, Coach, Parent, Swimmer).
3. Acceptable Use
You agree not to use the Service for any unlawful purpose or to:
- Upload, post, or transmit any data that you do not have the right to, or that is unlawful, harmful, or offensive.
- Impersonate any person or entity or falsely state your affiliation with a person or entity.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or our computer systems.
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
4. Club Data and Intellectual Property
Our Intellectual Property
The Service itself, including all underlying software, technology, text, graphics, logos, and the "MyAthlete" name, are the exclusive property of MyAthlete and its licensors. You may not copy, modify, or reverse engineer any part of our Service.
Your Club's Data
As between you and MyAthlete, your Club owns all the data you and other members of your Club provide or generate within the Service (the "Club Data"). This includes all athlete information, performance data, training logs, and POD rosters. We claim no ownership over it.
We will only use the Club Data to provide, maintain, and improve the Service, as described in our Privacy Policy and our Subscription Agreement with the Club.
5. Fees and Payment
The Service is provided to Clubs on a subscription basis. All fees are determined by the Subscription Agreement between MyAthlete and the Club. Individual users (Coaches, Parents, Swimmers) are not responsible for these fees unless they are also the primary Club Admin who entered into the agreement.
6. Termination
Your individual account may be terminated or suspended by your Club Admin at any time.
We may suspend or terminate your access to the Service if you materially breach these Terms. If our Subscription Agreement with your Club terminates, your access to the Service will also terminate.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind.
While we strive for excellence, we do not warrant that the Service will be uninterrupted, secure, or error-free. Features like the AI Time Prediction are provided for informational and motivational purposes only; they are statistical estimates and not a guarantee of future performance.
8. Limitation of Liability
To the fullest extent permitted by law, MyAthlete shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, revenue, or profit) arising out of your use of, or inability to use, the Service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. For material changes, we may also notify your Club Admin directly.
